(Circuit Court of Cook County, IL No. 13-CH-07790) ($11.1 million derivative settlement); Milliken v. American Realty Capital Hospitality Advisors, LLC et al. (U.S. District Court S.D.N.Y. No. 1:18-cv-1757) ($15 million derivative settlement); and Gamburg et al. v. Hines Real Estate Investment Trust, Inc. et al. (Circuit Court for Baltimore City No. 24CV16004496) ($3.25 million class and derivative settlement).
During the July 2021 hearing on Plaintiffs’ motion for final approval of the settlement reached in Magowski v. The Parking REIT, Inc. et al., the Honorable Lawrence P. Fletcher-Hill who presided over the case stated: “I’m satisfied from all that has been submitted in very careful detail…that the result obtained is certainly adequate, probably more than adequate, for the claim. And that [settlement] value… is at least half and maybe a little bit more than half of what Plaintiffs would consider the maximum possible recovery.”
Our attorneys also have substantial experience in complex commodity futures litigation. For example, Mr. Malmfeldt represented a commodity pool in the MF Global, Inc. bankruptcy proceeding (In Re MF Global, Inc., U.S. Bankruptcy Court S.D.N.Y. No. 11-2790), prosecuting a claim for wrongful liquidation in violation of the Commodity Exchange Act, and obtaining court approval of the claim in the amount of $2.1 million which made his client one of the largest non-affiliate general creditors.
